De Kuyper sentenced; serving term on Rikers Island

Lewes resident Scott de Kuyper was sentenced Sept. 5 to one year in jail  for bringing a handgun to a Manhattan courthouse in 2012.

New York Department of Correction officials said de Kuyper was taken to the Eric M. Taylor Center on Rikers Island where he will serve his sentence. Although the Manhattan District Attorney's Office said de Kuyper was sentenced to one year in jail, a Department of Corrections spokesman said he is scheduled to be released April 27, 2014. Neither department could say whether he was given credit for time served which would account for an earlier release date.

De Kuyper pleaded pleaded guilty July 17 to second-degree attempted possession of a weapon.

In 2012, de Kuyper appeared at a Manhattan courthouse to face charges following an Occupy Wall Street rally Oct. 15. Court records stated de Kuyper tried to tear an officer's badge off his uniform. He was charged with fourth-degree attempted grand larceny, second-degree obstruction of governmental administration, resisting arrest and disorderly conduct. The Manhattan DA's office had no further information on the original charges, other than the weapon possession charge to which he pleaded guilty. In a social media post de Kuyper said the other charges had been dropped.

When de Kuyper arrived at the courthouse in February 2012 for a hearing on those charges, he was arrested because his backpack contained a handgun and ammunition. At the time, de Kuyper said he had a Delaware Concealed Deadly Weapon permit which allowed him to carry a hand gun; however, he said he had forgotten that the gun and separate ammunition were in the pack that he carried to court.

De Kuyper's attorney Simon Gideon could not be reached for comment. In a previous interview, Gideon said de Kuyper has stage IV thyroid cancer; he blamed de Kuyper's lapse in judgment on a synthetic thyroid hormone de Kuyper took to treat the cancer.
