Ellendale man charged with assault against canine

A 33-year-old Ellendale man faces charges after police say he struck a police dog Aug. 5 during a violation of probation investigation.

Delaware State Police went to a home in the 2000 block of Bowers Beach Road at 3:30 p.m. to check on a violation of probation concerning Robert N. Berry, who had cut off his GPS tracking device, said Master Cpl. Gary Fournier of the Delaware State Police.

When police arrived at the home, Fournier said, a resident told officers that Berry had gone upstairs. Police informed Berry that if he did not surrender, Ripper, a K9, would be released, Fournier said.

Ripper found Berry in a small attic area, where Berry struck the dog in the neck, causing the dog to tumble onto his back, Fournier said.

Ripper jumped up and began biting Berry's left leg until police took Berry into custody.

Berry was taken to Kent General Hospital where he was treated and released for puncture wounds to his leg; he was later charged with resisting arrest and second-degree assault on a law enforcement canine. Berry was committed to Vaughn Correctional Center in default of $2,000 cash bond on the charges and $50,000 cash bond for violation of probation.

Ripper was uninjured and continues to work.
